    Discrimination: retirement conversations

PLEASE NOTE: Information in this article is correct at the time of publication, please contact DFA Law for current advice on older articles.

An employment tribunal case appears to provide some reassurance for employers that it is possible to approach retirement conversations in a non-discriminatory manner. The tribunal dismissed claims of unfair dismissal and age discrimination, despite several age-related comments having been made to the claimant during the course of her employment, including comments about her retirement plans. These were found to be reasonable in the context of succession planning, and the management of that process, and did not constitute age discrimination.

This checklist sets out the different types of discrimination that can occur within the workplace and highlights practical steps businesses can take to help avoid breaching discrimination and harassment law.
