Wrong Will Case in Supreme Court

PLEASE NOTE: Information in this article is correct at the time of publication, please contact DFA Law for current advice on older articles.

The widely reported case concerning an elderly couple who signed each other’s wills by mistake has reached the Supreme Court.

The case sparked outrage because the incorrect signing of the wills was an obvious error but the ruling of the Court of Appeal meant that the couple’s estate was destined to be distributed in a way that was clearly contrary to their wishes.

The judgment is expected shortly and, should the Supreme Court overturn the decision of the Court of Appeal, it will open the door for more wills to be challenged.

It may well be worth checking that your will is up to date and completed correctly. We would be pleased to review your will with you to ensure that it is appropriate in your current circumstances.
