Insuring a House in Probate – Everything You Need to Know

PLEASE NOTE: Information in this article is correct at the time of publication, please contact DFA Law for current advice on older articles.

    What is probate?

Probate is the legal right to deal with someone’s estate, including their property, money and possessions, after their death. This can often be a lengthy legal process, which can mean that properties sit empty for a long period of time; as without probate, a house cannot be sold or move forward with any other important processes.

    What is probate house insurance?

Probate home insurance is insurance that can be placed on a house in probate which provides security while the legal process is ongoing. This house insurance during probate often involves regular inspections of the property and the installation of security systems recommended by the insurers in order to gain a more competitive quote.

Who is the insurance issued to?

When insuring a house in probate, the insurer will need to confirm that the interested party has an ‘insurable interest’ in the property, which means verifying that the party would suffer a loss should the property be damaged or broken into. In the case of probate property insurance, this means verifying the party is the likely eventual owner of the house once all legal proceedings have taken place. This can also be the executor of a will, or of an estate.

What if someone is still living in the property?

There are probate home insurance products that cater to both occupied and unoccupied properties, including occupied house insurance during probate. The property being occupied will also reduce the quote given for insuring a house in probate, as risks to a home are greatly reduced if a property is occupied, such as break-ins or any maintenance problems.

DFA Law can help with obtaining house insurance during probate, and all other aspects of estate administration. You can get in touch with one of our experts on 01604 609560 to find out more.
